The ERA was approved by Congress in 1972 and, by 2020, ratified by 38 states. The letter asks President Biden to instruct the National Archivist to certify and publish the ERA as the 28th Amendment without delay. 

WASHINGTON, D.C. (December 3, 2024)—Style Weekly published yesterday an official letter to President Biden dated November 22, 2024, signed by 46 US Senators. 

The letter urges President Biden to enshrine equal justice under the law in the US Constitution by instructing the National Archivist to certify and publish the Equal Rights Amendment as the 28th Amendment.  

The US Senators write: 

The ERA is the most powerful tool available to put an end to the rollback of women’s rights, as well as civil rights more broadly. It would serve as our best chance to guarantee equality for all, free from the whims of anti-equality judges and politicians; guarantee equal pay and opportunities; restore reproductive rights; protect women from domestic violence and sexual harassment; put an end to gender and pregnancy discrimination; and more.

The Equal Rights Amendment was approved by two-thirds of Congress and ratified by three-fourths of the states yet remains unpublished. It’s the only amendment that has met the qualifications of Article V of the Constitution that has not been added to the Constitution.

US Senator Kirsten Gillibrand will join a national town hall at 7 PM ET on Tuesday, December 3, 2024, hosted by the Biden Publish the ERA Alliance, to discuss the campaign to publish the ERA. The Alliance consists of thirty non-profit, non-partisan advocacy organizations representing millions of members calling on President Biden to publish the ERA before the end of his administration.
