Posted on July 13, 2022 Challenging Corruption Share: WASHINGTON, D.C. — The nonprofit, nonpartisan legal advocacy group Free Speech For People and the grassroots advocacy group Our Revolution are calling on secretaries of state across the country to follow the mandate of Section 3 of the 14th Amendment of the Constitution and sign a declaration that former president Donald Trump is barred from running for any future public office based on his incitement of an insurrection on January 6, 2021. Enacted in the wake of the Civil War, Section 3 of the 14th Amendment disqualifies any individual who has taken an oath to uphold the U.S. Constitution and then engages in insurrection or rebellion against the United States, or gives aid or comfort to those who have, from holding future public office. The declaration, prepared by Free Speech For People, carefully details why Donald Trump is constitutionally barred from appearing as a candidate on future ballots. The declaration includes citations to case law affirming the role state election officials have in determining a candidate’s constitutional eligibility, relevant facts of the events leading up to and including the insurrection on January 6, and legal analysis of the definition of “insurrection” and “engage.” The distribution of the declaration is the newest initiative of the 14point3 campaign, a national project co-led by Free Speech For People and Our Revolution. In addition to sending the declaration to secretaries of state across the country, the campaign is actively mobilizing grassroots supporters to urge their secretaries of state to sign the declaration. To date over 50,000 people have signed petitions urging their election officials to act. “Secretaries of State have a duty to ensure that candidates who seek to appear on their state ballots meet the constitutional qualifications for serving in public office,” says Alexandra Flores-Quilty, Campaign Director for Free Speech For People, “We are urging them follow the Constitution and and declare that Donald Trump is barred from ever again holding public office, as is required under the 14th Amendment to the US Constitution.” “Trump is plotting a return to power, and we’re not wasting any time putting the overwhelming evidence into action,” said Joseph Geevarghese, executive director of Our Revolution. “Our members are leading public demonstrations across the country, amassing signatures, and delivering letters to chief election officials, calling on them to do their job, protect democracy, and enforce the Constitution – which disqualifies insurrectionist oathbreakers like Trump from ever serving in government again.” Read the declaration here.
