Today, the NAACP Tri-State Conference of Idaho-Nevada-Utah, represented by Free Speech For People, Mayer Brown LLP, and Woodburn and Wedge, moved to intervene in Dagusen v. Aguilar, a lawsuit brought by the Trump campaign, the Republican National Committee, Nevada Republican Party, and a voter demanding an unlawful purge of Nevada’s voter rolls just weeks before the November 2024 general election.

The lawsuit, filed on September 11, 2024 in Nevada state court, alleges that thousands of noncitizens are listed on the Nevada voter rolls and have cast ballots in previous elections. Plaintiffs claim that DMV records do not match the current statewide registration system, but do not account for the fact that many non-citizens lawfully obtain drivers’ licenses and then become naturalized citizens and voters before their licenses expire.

The Democratic National Committee and Nevada Democratic Party, both Defendants in the case, moved to dismiss the case on October 3.

As a Defendant-Intervenor, the Tri-State NAACP would be able to speak for its members and its communities, defending them against Plaintiffs’ eleventh-hour attempt to disenfranchise potentially thousands of citizens, including naturalized citizen members who are most at risk of having their voter registration invalidated by this challenge.

It is unlawful to ask a Court to purge the voter rolls this close to an election, and doing so will only cause confusion and intimidate thousands of voters who, having registered lawfully, now must question whether they have the right to vote and have that voted counted,” said Free Speech For People Counsel Amira Mattar. “Plaintiffs’ claims are baseless. They can point to no pattern in Nevada or anywhere else of noncitizens voting, and neither noncitizens nor properly registered citizen voters should be used as scapegoats in the Plaintiffs’ outrageous efforts to try to undermine the results of the 2024 general election.
