FSFP Legal Director Ron Fein recently joined Erin Burnett Outfront on CNN to discuss our legal challenge to Rep. Madison Cawthorn’s candidacy for reelection under the Fourteenth Amendment’s Insurrectionist Disqualification Clause, based on evidence that he helped facilitate the January 6, 2021 insurrection.

“When we have Members of Congress or other officials who are taking their oath to support the Constitution and then trashing it as they engage in the insurrection, the Republican Congress that passed the Fourteenth Amendment wisely said that those people should never be entrusted with public office again and that is why we’re bringing this challenge,” said Fein.

Free Speech For People filed the legal challenge, on behalf of a group of North Carolina voters, to the eligibility of Rep. Cawthorn to appear on the 2022 primary ballot in North Carolina. In accordance with North Carolina state law, the burden of proof now shifts to the lawmaker to prove before the North Carolina Board of Elections that he is indeed qualified for re-election and is not an insurrectionist.

MSNBC host Joy Reid also featured the lawsuit in a recent segment about a number of Trump allies who took part in the effort to overturn the 2020 election.
