Free Speech For People’s President John Bonifaz appeared on Glenn Kirschner’s Justice Matters last week to discuss the 14point3 campaign, which seeks to bar insurrectionists including Donald Trump from any future ballot. Kirschner is an NBC legal analyst and a former federal prosecutor.

Under Section 3 of the Fourteenth Amendment, public officials (including the President and Members of Congress and state legislatures) who take an oath to uphold the Constitution, and then engage in insurrection, are disqualified from holding future public office.

“For the second time in our nation’s history, we’ve had an insurrection: January 6, 2021,” Bonifaz noted. “Section 3 of the Fourteenth Amendment must be applied to anyone who has taken an oath of office, and then turned around and engaged in that insurrection.”

Bonifaz stressed the danger of state election officials deferring to federal authorities, noting that many state officials want to “pass the buck to the federal Justice Department for them to act first.”

Kirschner expressed enthusiastic support for FSFP’s campaign, which he called “heroic, and a democracy-saving effort.”
